These terms apply when you pay for any goods or services from your chosen merchant (Merchant) by telephone or over the internet (eCommerce) (the Dojo Services). Your payment will be enabled by Paymentsense Limited (operating through Dojo, a Paymentsense brand).
Paymentsense Limited is a company registered in England with company number 06730690 and our registered office is at The Brunel Building, 2 Canalside Walk, London W2 1DG. We are authorised and regulated by the Financial Conduct Authority (FCA FRN 738728) and under the Electronic Money Regulations 2011 (FCA FRN 900925) for the issuing of electronic money and provision of payment services.
Please read these terms carefully. By accessing or using the Dojo Services to pay the Merchant, you confirm that you agree to these terms. These terms are available on our website at any time to download and save by accessing our website. We may change these terms at any time by updating them on this webpage.
A Merchant allows you to pay for any goods or services offered by it using the Dojo Services. The relevant Merchant will set the price for the goods or services that it offers for sale and it is free to change them at any time. The relevant prices will be as outlined on the Dojo Services.
Payment transactions made via the Dojo Services are subject to checks by us and authorisation and authentication checks by your card issuer. We are not responsible if the payment is refused, including if your card issuer declines to authorise payment for any reason. We are not responsible for any online handling fee or processing fee that your card issuer may charge you.
If you want to amend or cancel a purchase once it has been placed, this will be subject to the Merchant’s terms and conditions. If you require a refund of any amount paid to a Merchant, the processing of that refund will be undertaken by the Merchant in accordance with its own terms and conditions and we have no liability in relation to it. You will need to contact the Merchant directly to discuss any full or partial refund.
You confirm that you will not use the Dojo Services to pay for any fraudulent, unlawful or abusive purpose.
The Merchant may need the following information to take the payment: your 16-digit card number, expiry date, and 3-digit CVC and your billing address. For you to consent to making a payment using the Dojo Services you will be able to confirm by: using a security code; and/ or proving it’s you with fingerprint or facial recognition.
Once you’ve given consent, you won’t be able to withdraw it. If you have not given your consent to the payment transaction please notify us and the relevant Merchant as soon as you become aware so we can try to correct this.
Valid payment instructions received by us from you using the Dojo Services will be transferred to the relevant Merchant by (i) the end of the business day after a payment transaction has been processed, unless due to technical difficulties or other unforeseen circumstances we are unable to achieve that timing, in which case (ii) as soon as possible but no later than the end of the third business day after a payment transaction has been processed, or (iii) such other timeframe as we may agree with the Merchant.
We reserve the right to refuse your ability to use the Dojo Services at any time if there is any misuse of the Dojo Services.
We might block your payment transaction on the Dojo Services if we're reasonably concerned about its security or that it might be used fraudulently or without your permission. We might also have to block your payment transaction to meet our legal obligations.
We must refuse to take your payment transaction in the following circumstances:
if legal or regulatory requirements prevent us from making the payment;
if you have broken these terms and conditions in a way that we reasonably believe justifies us refusing your payment;
if we believe that processing your payment instruction would break these terms and conditions or that your instruction doesn't contain all the information we need to make the payment properly;
if a third party prevents us from making the payment (for example, if your card scheme does not allow a payment using your card); or
if we have asked you for important information we reasonably need and you have not given us that information.
You agree that your use of the Dojo Services is on an 'as is' and 'as available' basis and at your sole risk. We make no representation or warranty of any kind whatsoever, nor accept any liability for, the Dojo Services, including but not limited to any breach of security associated with the transmission of information through it. To the extent permitted by law, we disclaim any warranty of any kind with respect to the use of the Dojo Services.
We will not be responsible to you for any loss or damage that you suffer as a result of our failure to use reasonable care and skill in relation to your use of the Dojo Services. We do not exclude or limit our responsibility to you for loss or damage where it would be unlawful to do so.
We cannot guarantee the continuous, uninterrupted or error-free operation of the Dojo Services. There may be times when the Dojo Services, or part of it, is unavailable (whether on a scheduled or unscheduled basis) or it may be modified, suspended or withdrawn by us without notice to you. You agree that we will not be liable to you or to any third party for any such unavailability, modification, suspension or withdrawal.

If we do not resolve the complaint to your satisfaction, you may be able to refer it to the Financial Ombudsman Service. You agree that your personal data may be retained, used and disclosed by us and our agents for the purpose of complying with our obligations under these terms including, but not limited to, administering any payment placed by you on the Dojo Services and complying with any legal obligations.
If a court or other authority decides that any part of these terms is illegal or ineffective, the rest will be unaffected and will remain in force. These terms are governed by English law and you can only bring legal proceedings in relation to them in the English courts unless you live in Scotland, in which case you can bring legal proceedings in respect of them in either the Scottish or the English courts.
